Xvision365 Cloud Privacy Notice

Cloud recording is not yet available on Xvision365. This notice is published in advance so you can see how the service will handle your footage. It will be completed with the final detail before the service is released.

When this applies

This notice applies only if you switch on cloud recording. If you do not, your footage stays on your own recorder and none of this applies to you.

Everything else about your account is covered by our Privacy Notice.

Who is responsible for the footage

You are the data controller for the footage your cameras record. You decide where the cameras point, what they capture and who can see it. We act as your data processor for footage stored in the cloud, which means we only handle it to run the service and on your instructions.

This matters if your cameras capture people. As controller, the legal duties are yours. In the United Kingdom that normally means putting up clear signs, pointing cameras away from neighbouring property and public areas where you can, keeping footage no longer than you need, and being able to respond if someone asks for a copy of footage of themselves. If you use CCTV for business purposes you will usually need to register with the Information Commissioner's Office. Guidance is on ico.org.uk.

What is uploaded

  • Video clips recorded by the cameras you have linked to a cloud plan.
  • Still images captured when an alarm is triggered.
  • The time, date, camera and alarm type for each clip, so you can find it again.

Nothing is uploaded from a camera you have not linked to a plan. Continuous recording is not uploaded. Only the clips your alarm settings generate are.

How long it is kept

Clips are held for the period included in your plan. When that period ends the clip is deleted automatically. You can delete a clip yourself at any time before then. If your plan ends or you cancel, stored clips are deleted after a short grace period, so download anything you want to keep before that.

The exact retention period for each plan, and the length of the grace period, will be published on this page when cloud recording is released.

Where it is stored

Cloud recordings are stored on Amazon Web Services infrastructure. Clips are encrypted while being uploaded and while stored. The region they are held in will be stated on this page when cloud recording is released.

Who can see it

You can, and so can anyone you have shared the device or group with. Our staff and our platform supplier's staff do not view your footage as a matter of routine. They may need technical access to fix a fault, and only where you have asked us to look into a problem, or where the law requires it.

Video relay

When your phone cannot reach your recorder directly, video is passed through a relay server so the connection still works. The relay carries the video between the two ends. It does not store it.

Requests from the police and others

If the police or another authority ask us for footage, we will normally direct them to you, because you are the controller. We will only hand footage over ourselves where the law obliges us to, and we will tell you unless we are prohibited from doing so.

If something goes wrong

If footage is lost or accessed without authorisation, we will tell you without undue delay so that you can meet your own obligations as controller.
