1. These terms
These terms are an agreement between you and Y3K (Europe) Limited, Airport House, Purley Way, Croydon CR0 0XZ, company number 03924841. They cover your use of the Xvision365 app and the account behind it. By creating an account you accept them.
2. What the app does
Xvision365 lets you view live and recorded video from Xvision recorders, cameras and video doorbells that you own or are responsible for, and manage those devices remotely. The app is provided free of charge. Cloud recording, where you choose to use it, may be paid for separately.
3. This is not a monitored alarm service
Nobody at Y3K watches your cameras. The app sends alerts to your phone and shows you video when you open it. It does not summon the police, a keyholder or any other response.
Do not rely on this app alone where a failure could lead to injury, or to loss you could not bear. Alerts depend on your internet connection, your mobile network, your phone's settings and services run by Apple and Google, and any of those can fail or be delayed. If you need a monitored response, ask your installer about a monitored alarm system.
4. Your account
- You must be 18 or over.
- Give us accurate details and keep them up to date.
- Keep your password to yourself. You are responsible for what happens under your account.
- Tell us promptly if you think someone else has got into it.
- We recommend switching on two-step verification.
5. Using the app lawfully
You are responsible for how your cameras are used. In particular you must not use them to record people unlawfully, and you must comply with data protection law where your cameras capture anyone other than your own household. That normally means clear signage, pointing cameras away from other people's property and from public areas where you reasonably can, and keeping footage no longer than you need it.
You must not use the app to harass, monitor or spy on anyone, to record in places where people expect privacy, or for anything unlawful.
You must also not interfere with the service, attempt to gain access to accounts or devices that are not yours, reverse engineer the app except where the law permits it, or use it to distribute malicious software.
6. Your video
Your video and images are yours. We do not claim ownership of them. Where you use cloud recording, you give us only the permission we need to store, transmit and display that content back to you and to anyone you have shared it with, for as long as you use the service. We do not use your content for any other purpose.
7. Sharing with other people
You can share a device or a group with someone else. If you do, they can see what those cameras see. That is your decision and your responsibility, including where the footage shows other people. You can withdraw access at any time.
8. Availability
We aim to keep the service running but we do not promise it will be available without interruption. It may be unavailable for maintenance, or because of faults in networks and services outside our control. We may change or withdraw features. If we make a change that materially reduces what the app does, we will give you reasonable notice where we can.
9. Ending this agreement
You can close your account at any time from the Account screen. We may suspend or close your account if you breach these terms, if we are required to by law, or if we stop providing the service, and we will give you reasonable notice unless the breach is serious.
10. Our responsibility to you
If we fail to meet these terms, we are responsible for loss or damage you suffer that is a foreseeable result of that failure. We are not responsible for loss or damage that is not foreseeable.
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded under English law. Nothing in these terms affects your legal rights as a consumer, including your rights under the Consumer Rights Act 2015.
Where you use the app for business purposes, we are not liable for loss of profit, loss of business, business interruption, or loss of business opportunity.
11. Changes to these terms
We may update these terms. If a change matters to you we will tell you in the app or by email before it takes effect. If you do not accept the new terms you can close your account.
12. Privacy
How we handle your information is set out in our Privacy Notice and, for cloud recording, our Cloud Service Privacy Notice.
13. Law and courts
These terms are governed by the law of England and Wales. Disputes may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland you may also bring proceedings in your own courts.
